Spectra Privacy Notice
At Spectra, we value your privacy and are committed to protecting your personal data. This Privacy Notice explains how we collect, use, share, and safeguard your personal information when you use our platform to access discounts and services from participating merchants, including restaurants, salons, and spas. This Notice is designed to comply with Quebec's Act respecting the protection of personal information in the private sector, as amended by the Act to modernize legislative provisions as regards the protection of personal information ("Law 25"), and, where applicable, the federal Personal Information Protection and Electronic Documents Act (PIPEDA). By using our platform, you agree to the practices outlined in this Privacy Notice.
1. Information We Collect
a. Personal Information
When you register for an account or place an order, we may collect:
- Name
- Age
- Email address
- Phone number
- Payment details (processed via Stripe)
b. Order Information
We collect details of your purchases, including:
- Items or services ordered
- Payment details (processed via Stripe)
- Date and time of the purchase
c. Usage Information
We collect data on how you interact with our platform, such as:
- Browsing activity
- Search queries
- Preferences
d. Device Information
We may gather details about the device used to access our platform, including:
- IP address
- Device type
- Browser and operating system
e. Age Verification Information
Proof of age may be required when using the platform or upon visiting a participating merchant.
f. Location Information
Spectra may collect location data from your device to confirm whether you are physically present at a merchant's location on the day of obtaining a ticket. This allows us to prompt you for reviews and feedback only when relevant. You may disable location access at any time through your device settings; doing so may limit certain features, such as review prompts.
g. SMS (Text Messages) for Verification and Account Security
When you provide a mobile number and opt in on our sign-in or verification screens, we use it to send one-time passcodes (OTP) and related transactional messages needed to create or access your account, complete bookings, or verify your identity. These messages are sent through our messaging providers (for example, Twilio). Standard message and data rates from your carrier may apply. You can opt out of marketing texts as described in our Terms; opting out of verification SMS may limit phone-based login until you opt in again. We log the time and version of the consent language you agreed to where required for compliance.
2. How We Use Your Information
a. To Provide and Improve Services
- Facilitate account creation, login, and management
- Fulfill orders and share necessary details with merchants
- Enhance user experience and evaluate the effectiveness of discounts and promotions
- Use location data to trigger relevant feedback or review requests
b. To Communicate with You
- Send order confirmations, updates, and customer support messages
- Notify you about promotions, new features, or platform changes
c. For Marketing and Rewards Programs
- Use your purchase history to offer personalized rewards and promotions
- Manage reward points, referral tiers, and redemption options
d. Legal Compliance
- Fulfill obligations under applicable laws and respond to lawful requests from authorities
Spectra does not currently use your personal information to make any automated decision that produces legal or other significant effects concerning you. If this changes, we will update this Notice to explain the logic involved and your right to be informed and to submit observations, as required by Law 25.
3. How We Share Your Information
a. With Participating Merchants
Order details are shared with merchants to provide services.
b. With Third-Party Service Providers
We work with providers, including Stripe (payments) and Twilio (SMS messaging), to operate our platform. These third parties are contractually obligated to protect your data and may only use it for the purposes for which it was shared.
c. For Legal and Compliance Purposes
We may disclose information to comply with legal obligations, enforce our terms, or protect Spectra, its users, or others from harm or fraud.
d. End-User Mobile Information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from all other data-sharing categories described in this Notice and will not be shared with any third party.
4. Payment Information and Security
Payments are processed securely through Stripe. Spectra does not store full payment details; we only retain necessary transaction records. Stripe's Privacy Policy governs the handling of your payment data.
5. Data Retention
We retain personal data only as long as necessary to:
- Provide services and comply with legal obligations
- Resolve disputes and enforce agreements
- Improve our platform and tailor user experiences
Specific retention periods vary by data type. IP addresses are retained for up to 90 days. Other personal data is retained indefinitely unless and until you request its deletion or delete your account, at which point it will be deleted, subject to any retention required by law.
6. Cookies and Tracking Technologies
We use cookies and similar technologies that allow for the identification, location, or profiling of users to:
- Track platform usage and improve functionality
- Personalize user experiences and recommend offers
You may deactivate these functions at any time through your browser or device settings. Deactivating certain technologies may limit some platform features.
7. International Data Transfers
Your personal information may be stored and processed outside Quebec. Before transferring personal information outside Quebec, Spectra conducts a privacy impact assessment evaluating, among other factors, the sensitivity of the information, the purpose of the transfer, the protective measures in place at the destination, and the legal framework applicable in the destination jurisdiction, in accordance with Law 25. Spectra only proceeds with such a transfer where it determines, based on that assessment, that the information will receive adequate protection.
8. Your Rights
Subject to applicable law, you have the right to:
- Access the personal information Spectra holds about you
- Request correction of inaccurate or incomplete information
- Request the deletion of your personal information, subject to legal retention requirements
- Withdraw consent for certain uses of your information, where consent is the basis for that use
- Request a copy of your personal information in a structured, commonly used technological format (data portability), where applicable
- Object to certain uses of your data, including for marketing purposes
To exercise any of these rights, contact us using the details in Section 14. We will respond within the timeframe required by applicable law.
9. Age Restrictions
Spectra is intended for use only by individuals who are at least 18 years of age, consistent with Quebec's legal drinking age and the alcohol-related offers featured on our platform. By registering for or using Spectra, you represent that you meet this age requirement. Proof of age may be required, and users providing false age information risk account termination.
10. Security Measures
We implement industry-standard security protocols to safeguard your personal data against unauthorized access, disclosure, alteration, or destruction.
11. Breach Notification
In the event of a confidentiality incident involving your personal information that presents a risk of serious injury, Spectra will notify affected individuals and, as required by Law 25, the Commission d'accès à l'information du Québec, without unreasonable delay.
12. Person in Charge of the Protection of Personal Information
In accordance with Law 25, Spectra has designated Najwa Elidrissi as the person responsible for the protection of personal information. You may contact her using the details in Section 14.
13. Updates to this Privacy Notice
This Privacy Notice may be updated periodically to reflect changes in our practices or legal requirements. Material changes will be communicated via email or a notice on our platform.
